Here are the vote percentages from each unit. Available on CUPE website. 

61.7% no from U1
59.3% no from U2
70% no from U3

 

THE STRIKE IS STILL ONGOING – NO END HAS BEEN REACHED.

    I honestly don’t think parliament is gonna reconvene until mid Feb. At this point, it’s up to York to decide whether or not they wanna bargain again. But here’s the real question that I’ve been pondering, and no one seems to have brought up.

    Is it worth saving this year if we’re gonna be screwed over again in 2010? I think 2010 will be much worse than this year.

    The one thing I can say is that the turnout was extremely high. The vote is very much reflective of rhe will of the membership. The university even chased down some students to go and vote.

    As far as a class action lawsuit goes, if and when you win your tuition fees back, the majority of that amount will be lost to pay the lawyer you hired for the suit in the first place…so basically you’ll end up at square one, with no money.

    The Union is also demanding that the University convert contract faculty to full-time academic positions based only on seniority, without review and without evaluation of their academic and research capabilities.

    To date the University has not received any comprehensive offer from the Union to settle the strike. When negotiations ended January 9, the Union still had more than 75 separate demands on the table.

    That does make sense…but it would take a SHITLOAD of us in order to be able to afford this and come out with anything in terms of green. $450 and hour is the going rate for a half decent lawyer…at a rate like that, wouldn’t you talk hours longer than you needed to? Considering how long a lawsuit against york would go…it’d definately take a large group of willing students. Just because everyone is pissed off, that unfortunately doesn’t mean that everyone is willing to get up and do something about it.

    I am in complete and utter shock that both parties seem to make decisions despite the impact on the 50,000 paying students who, in some cases and I’m sure majority, have their entire lives on hold.     Nov. 6, strike starts
    Nov. 13, 7 days of bargaining later, forced ratification vote
    (10 days of wasted time pass so that cheap paper ballots can be organized, and govmt officials can find ritzy hotel to host)
    Nov. 24, “supervised vote” is defeated by all three units

    Then what?

    Probably nothing until NOW. It would have been zip from York U until the last week of January.

    I realized about a week ago, with absolute certainty, that York U doesn’t give a…well…

    Anyway, the only threat the Union EVER had, was the loss of summer classes and that kind of income. That is the only fear that York U INC ever had. I mean, what else can’t they afford? Really. A strike is a right of passage at York. “Their reputation?” It already sucks in this regard, look back to the 70s.

    In a sudden flurry now, York U will graciously slide in and offer something reasonable, because suddenly, their pocket book could be hurt. Summer classes can be pushed to August, but no further.

    And that’s the game folks. That’s it. That’s all it was ever going to be. Next time, it will be the same thing. Those are the cards that are dealt.

I have been working full time since teh strike started and honestly I didn’t mind a nice break in the middle of this freakin cold weather. its not that you don’t have a chocie I have friends who transferred to ryerson and what not; if you hate york taht much go ahead and do that. on the flip side I am not saying what cupe is doing right. They should have taken it to the binding arbitrator long time ago. The real villain here is the university admin, like late communication with students, keeping everyone in dark and then issuing a long complicated press release. I believe that we all are attending university and should be mature enough to face the reality.     Okay, I see some people talking about the students banding together. Cna anybody tell me how many students showed up to the rally they were supposed to have had in Vari Hall on Monday? I wasn’t there. But I’m thinking that ed is one to something here. 50,000 – even a quarter or an eigth of that can possibly make an impact. What do you think?

    Can the students, maybe those on here start a petition that can be sent to the government urging them to step in? Can parents flood the government with emails and phone calls? Can students call?

    Actually, maybe the people to ask is York’s Student Association/Union/Government. Does York even have one? I mean an official group OF STUDENTS that lobby for student right? Serious question looking for a serious answer?

    Or maybe there is a famous civil/social activist who can take up the cause for the students via the media. The media is still the fourth estate in any civilized society and whether you believe it or not, the media makes an impact. does anybody have a friend or associate in the media who can come and do a REAL story on campus? (Or has this already been done?)

    International students, does your country have an ambassador to Canada who can write the government person to urge them to actively get involved? Is it worth a try?

    And how about the leaders of this site? You seems to have a sizeable following here. Maybe you can organize something so that people can see who is really being affected here – the students.

    The labour troubles at York University have gone on far too long.
    I’ve already sent a message to Mr. Milloy, to which his response reiterated your party’s belief in the collective bargaining system.

    This system is usually successful, but for all the successes it has had, there is always a time when one must come to the realization that something has not worked.

    How can one believe in a system of negotiations where only one, or at times even none, of the parties involved choose to properly negotiate.

    The collective bargaining system in this case has failed. CUPE are demanding far too much, and York Administration has been limiting what they want to hear.

    A solution cannot be reached unless our elected members of parliament step in and answer the call of the voters.

    As members of parliament, as prime minister, you and your party have vowed to serve the public. It is your time to act.

    We need to get York students back into the classroom.
    This means back to work legislation, this should be a primary goal.

    I also propose a very important piece of legislature for future reference. When negotiations are ongoing between Unions and Employers. These parties should devote all their time towards the negotiations, it will speed up the bargaining process.

    I noticed far too many times during the course of this York strike where one or both sides have called for breaks from negotiations. They referred to these as “cooling down periods”.

    I see this as time wasting and the only real victims damaged by this are the only people that should matter here…the students.

    Mr. McGuinty, the public you’ve been elected to serve has called to you for help. Will you heed their call?

    Please do not disappoint me and the countless other students and their parents, who are desperate for a solution and have lost faith in the parties involved.

    Please do not cause me and the countless other voters to lose faith in you and our elected officials, whose job it is to serve the public, humbly and justly.

    I can sympathise with CUPE’s demands and their fight for their own cause, I just don’t get what the point of setting up a picket around the perimeter of the university is and delaying people who need to get inside. Even without that, if the T.A.’s aren’t working, school would still be out.

I think the union’s bargaining team might be willing to drop or lower some of them (but probably few) in order to get back to class quickly, but we’ve already lowered and dropped a hell of a lot already with very little movement and very little negotiating from York’s side. I expect we’ll stay rather firm and that York will give in to most within a short time in order to avoid cancelling the summer term.

    York says ” negotiations are at impasse”.

    I’m with you. York administration has been ridiculous throughout this strike (in fact, they were ridiculous before the strike as well). As far as I can tell, they’ve really made no real effort to get students back to school. Their moves have been purely political; for show to make CUPE look bad.

    Remember that it’s YORK ADMINISTRATION’s responsibility to deliver the goods and services for which I’ve paid. It is their responsibility to keep their employees happy. York administration is certainly not a victim here, they are at least (in my opinion more) responsible for this ongoing strike.

    From that perspective, I think a law suit, demonstrations, etc. are good things. It’s a good idea to take action to push York into making a real offer.

    I think the picket lines serve several functions:

    1) It gives members a chance to meet together, discuss the issues, get to know one another, etc. This may seem insignificant to anyone listening but I’ve found it to be quite important. I’ve been able to meet way more people accross many different deparments that I would never have talked to before. We talk a lot about the strike and what it means to each of us, what our goals are in the strike, developing strategy, etc. It also helps keep moral up.

    2) It gives us a chance to counter the PR being spun by the university by talking to car drivers/passengers, etc. that are coming into the university and give them our point of view.

    3) It’s symbolic – it doesn’t outright shut down all the functioning of the university, but it ‘disrupts’ it, as is legally entitled during a strike.

    4) According to cupe national’s rules (CUPE has 560,000 members nationally), we must participate in strike duties in order to get strike pay (up to a maximum of $200 per week). Picketing and ‘alternatve duties’ are a means of determining who gets paid and who doesn’t.

    CMWC .. almost all of the reasons you have provided I agree with wholeheartedly; you’re right, all of those things are completely reasonable and understandable.

    However, they would serve the same purpose if the picket was going on in the big park of York commons.

    Instead, they are set up around the entire campus, which is indeed efficient at demonstrating the magnitude of the situation and discharging an echo of your fight for better wages and overall employment; but they are also counter-beneficial to a party that is completely innocent, which is the students. Perhaps a minor sacrifice for the greater good in your opinion, but I am quite disappointed, because it’s hard not to feel like there is animosity directed at me in situations like this.

    Am I being too sensitive, CMWC? Because I think I’m being pretty reasonable.

    1) tuition freeze expires after the second year so the university could take back all our gains in the collective agreement simply by raising tuition fees in the 3rd year of the contract. A 2 year contract will allow us to bargain tuition rebates accordingly for our next contract.

    2) Lining up collective bargaining accross the province for 2010 which I’m sure you’ve already heard about and don’t need me to explain it to you.

    While a 2 year contract is preferred, I don’t think it’s a deal breaker, so I think you’re quite wrong if you think that. Every member I’ve talked to would prefer a good 3 year deal to a bad 2 year deal.

    As for what you think is embarrassing CUPE members on the line or what you think they know or don’t know – I can’t speak to that. By suggesting that our demands are already high and then saying that everything would be fine if we dropped the 2 year contract demand tells me that you aren’t as informed as you think you are.

    Not for long. It is too embarrassing for the government that’s already ignored you too long. It is too humiliating for York and 3903. The strike would be over in 48 hours. Whether via legislation or compromise doesn’t matter. Nobody would dare ignore York students longer if you took your own campus back.

    Any sort of legal action against the University will end up being ultimately fruitless. You’d have to prove that they have not been bargaining in good faith. Good luck.

    The sad part is, Unions are actually economically counter-productive, FOR EVERYONE. Economists largely agree that Unions tend to result in WORSE wages and working conditions for union members and worse conditions for their employers as well. Unions were a necessity before the minimum wage and employment legislation (on standards, etc.) but now they do nothing but hold the employees back. (If anyone’s interested in the theory, simply reply and I’ll try and explain it as best I can.)

    Don’t expect a tuition refund, just do the simple math: 50,000 x $5,000 (avg) = $250,000,000. If York gives you back your money, you better use it to apply to another institution, York will be history. While I’m sure no student is happy paying into thin air, remember that York must keep paying their staff, groundskeepers, rent, etc.

    Counter to what many of you think, our universities are HEAVILY government subsidized. If you think they’re rolling in it, think again. The government is about to head into recession, the universities are losing donors and endowments by the minute. The last thing they can afford to do is give in to CUPE or to give a refund. Don’t convince yourself that you’re fighting against a multinational, multi-billion corporation, you’ll be sadly disappointed.

    On the issue of supporting CUPE… yes, they do have the legal right to strike. Personally, I believe they’ve taken their “right” too far and are indeed demanding the impossible in such an economic climate.

    Now let’s do a thought experiment to all of you thinking of “action” against York (or CUPE for that matter):

    Sue York
    ————
    York is forced to repay $250,000,000 (which it does not have). Your tuitions rise. York’s popularity and thus admissions drop. Your tuitions rise.

    Sue Cupe
    ————
    They have the absolute right to strike. A lawsuit would have to prove that they are not bargaining in good faith (very difficult, especially given their obvious support from the union). Assuming you win, CUPE takes a large hit and takes it out on you in 2011, demanding even more in compensation for this defeat.

    CUPE Wins
    —————
    York ends up doubling its cost for the union. Tuition rates go up. You get another strike in 2010, this time with the support of other unions.

    York Wins
    ————–
    CUPE hides out til 2011, and then strikes again in retribution for being unable to participate in 2010. You can bet they’ll demand at the very LEAST, equity to whatever was secured in 2010, and probably more for the aggravation York caused them.

    Government Intervention

    Probably the best solution. Sets a precedent, communicating to other unions that the government is not willing to stand by while they strike. However, this is almost entirely political suicide on the part of the Liberals, and the NDP will stand to gain many seats in the next election. Being seen as the “oppressors” of unions is something the government will do their best to avoid, ESPECIALLY as they are faced with an imminent strike in 2010. However, I believe that in the case of BTWL, the Union is not bound to a contract, and therefore WILL probably strike in 2010.

    Apply to UofT (or other schools)

    50,000 students applying to other universities implies higher tuition rates everywhere else, on top of higher acceptance requirements. The more apply, the less get in.

    Yes, the overall situation is grim, but demanding the impossible as students (lawsuits, refunds, CUPE’s victory) is probably NOT the better solution. March on Queen’s Park and demand BTWL. By doing this you ensure your tuition rates most likely do not rise drastically, you weaken the overall position of CUPE unions in the future, you ensure York does not go under, and the government is assured that they will be supported in BTWL (50,000 guaranteed voters for the Liberals if McGuinty comes through).

    And no, I am not a York Student. I go to UofT, while my girlfriend attends York. However, I find myself interested by the entire situation and thought I would share my opinion with you guys. If it’s not welcome, sorry. 😦

    I think the classroom serves several functions, very similar to your picket lines.

    1) It gives students the chance to meet each other and discuss topics needed for fulfilling the CREDITS THEY ALREADY PAID FOR.

    2) If you (CUPE) try to talk to me in my car as I’m going to the library to do my studies ON MY OWN BECAUSE YOUR UNION IS ON STRIKE I will tell you that instead of talking to me, you should be pressuring your bargaining team should be meeting with York Admin instead of stonewalling them like a three year old.

    3) The only people you are “disrupting” are us. Your students. Who you apparently care about so much. As we try to do our studies ON OUR OWN that we paid IN GOOD FAITH to be TAUGHT.

    4) While you are making $200 a week in strike pay, we are out, on average $5000 for tuition, and have been hesitant to get full-time jobs because we believe that once you sign up for something, you should FOLLOW THROUGH. (Imagine.)

    3) It’s not just students coming through the picket line. In fact, I’d say it’s less than half.

    4) By all means take up a claim against York university to reclaim your tuition fee. I’ve also paid a tuition fee. Since I don’t have a contract with York that is worth working for I excercise my right not to work.

    I am a fellow TA and cupe member. I can honestly say that I am disappointed with both how the university is proceeding, as well as with how our union has conducted the strike. There is so much misinformation going around it’s almost ridiculous. Also – I urge you not to have it “in” for all your TA’s after the strike is over. I voted to accept the University’s offer, and not to start the strike to begin with, and I am suffering just as much as the undergrads going without pay for 3 months and not having any classes. I just hope the union can soften a bit and the University can stop pointing the finger and they can start to discuss a compromise.

    fellocupe, would you and other TA’s with your mindset be willing to join the students in a rally? if so, at 7pm tomorrow night in the bethune dining hall, there will be students organizing said rally. you can probably invite your colleagues.

    I can’t attend the rally tomorrow due to other obligations (program related). But honestly, I have a feeling the strike will be over soon. I hope the government steps in. And cupemember with a child- please be more aware of how you are talking to these students and what a bad reputation you are giving us with your pointless slandering. For all the undergrads in here – not all us TA’s are of the same mindset!

    Actually, it wasn’t 1400 that voted. It was 1400 that voted no. The numbers that I read were:

    TOTAL
    Yes: 875 (37.4%) No: 1466 (62.6%)

    TURNOUT: 2341 valid votes out of 3340 members (70%)

    First we do not need TAs to whoever posted that up above. TAs do not teach. That is the contract lecturers who teach.

    Second why the he*l does not York just say, fine, done, bye bye Cupe, teach if you want, strike if you want, and for courses where the contract lecturer wants to stay striking just ask full-time real profs to teach an extra course and they will pay them the money that would ve gone to the Cupie?

    Last thing, to Fellocupe up above, sorry but I DEF DEF have it in for the TAs who voted to strike on and on and on. Greedy Cupe member up above says they have dropped all kinds of demands, I say bull. This is like a game to them. Most are masters students just finished u-grad and full of self-righteousness with no responsibilities to balance it out. Fellocupe if you are so wanting to not be lumped in with the MORONS then y you not do sumthing about it, speak up more. Seriously this is addled and I am like everyone else really angry right now.

    York admin is idiots for letting there be unions for ppls without actual jobs (Just contract positions). And Unions is arrogant greedy ones who will say and do anything to feel like they are noble. Get better admin than Dr. Shoukry who is a fundraiser not a ruler and turn this thing around.

    Ontario Premier Dalton McGuinty appointed a mediator on Wednesday to attempt to resolve the long-standing strike at York University.

    Mr. McGuinty said he is sending in the province’s top mediator, Reg Pearson, to ”bang a few heads together” after union members rejected the school’s latest offer.

    ”Obviously, we’re going to do everything we can to bring the sides together,” Mr. McGuinty told reporters.

    However, he has not set a deadline for the mediation process. Nor would he comment on what he plans to do if mediation fails.

    Many fellow TA’s are speaking up and have brought their concerns to the union. Unfortunately the union leaders have their own agenda.

    Please don’t be mean to us!!! Don’t forget we are the ones grading your exams!!!

    Oh, and I resent the comments that we are self-righteousness with no responsibilities…. Many of us pay 7,000 in tuition yearly, hold external scholarships, and work placements in our field. I am sure this differs across different programs but I have had to work my a** off to get where I am, I have more responsibilities than I know what to do with.

    Anyway – point is I feel blessed to be where I am and I think our current contract, as TA’s are great. I think the union leaders may be being greedy, but they will get what’s coming for them. I, on the other hand, just don’t want to be treated like crap by my students because of a couple of dummies leading our union. I already feel like the TA’s are york are not respected even before the strike, G-D knows what it will be like now. I NEVER talked back to my TA’s when I was an undergrad at other university.

    There is always good amidst the bad…however, please refrain from adding to the presssure of being a loser york student…and what exams are there to mark anyway…..??????????

    Of course it’s not a threat! I just don’t understand how some undergrads can be so rude to their TA’s…. Didn’t you know we do ALL the grading. Would you ever be rude to your proffs? No… Meanwhile it would probably make more sense considering the Prof never sees any of the exams… TA’s do all the marking, including assignments, exams, short answers, papers… etc… I don’t know I was always way too scared to be mean to my TA’s… then again I cared about my grades. Anyway – about 40% of TA’s voted to end the strike. So that means approx. half your TA’s are not the “bad”

    I am not a student or faculty of York…

    I would be willing to stand in front of a lecture hall, class, whatever, and “teach” so the media could have a field day with the comments on this strike. If we could get the media there, the students could speak for themselves….and No Cupes allowed..after all….it a lecture….titled….
    How to get along with your peers… waddya think??+
